The D&D 5E Charactermancer doesn't follow the Proficiencies rule: "If a character would gain the same proficiency from two different sources, he or she can choose a different proficiency of the same kind (skill or tool) instead." A Rogue should be able to choose a tool other than thieves tools if they also have the Criminal background.
